Welcome to EcoComply GmbH (“EcoComply”, “we”, “our”). By using our website, Platform, or services, you agree to these Terms.
Our goal is to help you navigate product compliance smoothly through a combination of software, expert support, and coordinated testing.

1. What We Provide

EcoComply offers two components that work together:
a) EcoComply Platform: A cloud software tool that helps you manage regulatory requirements, technical files, documentation, and compliance workflows.
b) End-to-End Compliance Support. Most of our service packages include practical support such as:

• regulatory guidance
• document preparation
• coordination with accredited testing laboratories
• assistance throughout the compliance process

Details of your package (scope, fees, timelines) are defined in your Order Form or Agreement.

2. Your Responsibilities

‍
You remain responsible for:

• providing accurate and complete product information
• ensuring your products meet applicable regulatory requirements
• reviewing outputs from the Platform and testing activities before use

EcoComply supports your compliance process, but does not certify products or act as a notified body.

3. Testing Laboratories

We work with accredited Partner Labs to streamline testing.
EcoComply prepares documentation, coordinates submissions, and manages communication as part of your service package.
Partner Labs perform tests independently and remain responsible for their results, timelines, and methodologies.
EcoComply is not responsible for laboratory outcomes, but we will support you in understanding and acting on the results.

4. AI-Assisted Features

‍
Some features of the Platform use AI to accelerate classification and analysis. Your data is not used to train external models, and AI outputs do not replace your own compliance decisions or professional judgement.

5. Confidentiality & Data Ownership

‍
You own all product information, documents, and materials you upload or share with us.
EcoComply keeps your information confidential and shares it only when required to deliver the services (e.g., with Partner Labs under NDA). We take appropriate security measures to protect your data.

6. Intellectual Property

‍
EcoComply owns the Platform, software, tools, and related materials. You receive a non-exclusive right to use the Platform during your subscription for your internal business purposes.

7. Fees and Payment

‍
Your package includes the Platform and the agreed Professional Services. All fees and payment terms are defined in your Order Form or Agreement. We do not charge unexpected or unapproved additional fees.

8. Limitations of Liability

‍
To keep services predictable and affordable, our liability is limited to the amount you have paid in the 12 months before any claim.
We are not liable for:

• regulatory decisions
• testing results or lab delays
• indirect or consequential damages (e.g., lost profit)

Nothing limits liability for intentional misconduct or required legal obligations.

9. Termination and Data Export

‍
If your subscription ends, you may request an export of your data within 30 days. We may delete data after 60 days unless legal obligations require retention.

10. Marketing

‍
We may identify your company as a customer (e.g., logo placement) unless you opt out by emailing hello@ecocomply.ai.
We will never disclose confidential information without written consent.

11. Governing Law

‍
These Terms are governed by German law. If you have a separate Master Service Agreement with us, that agreement takes precedence over these Terms.
